Liability for failure to fulfill loan obligations can vary. For some, non-payment can lead to the accrual of fines and penalties, while for others, it can result in criminal liability. For non-payment of a loan by the specified deadline in the loan agreement, the bank may impose one of the following penalties:

  • a fixed amount;
  • a percentage of the total debt amount;
  • a percentage of the overdue debt.

Let's examine each of the possible cases in detail.

A loan is considered overdue if, on the date set by the payment schedule, there are insufficient funds in the borrower's account to make the monthly payment. Despite the fact that the bank sets the payment period and informs the borrower about it when signing the contract, some people systematically fail to fulfill their obligations, deviating from the schedule.

Of course, there is no serious liability for such minor violations. In this case, the debtor will have to pay a fine for violating the terms of the contract and interest for each day of delay. The amount of each penalty is individual and largely depends on the loan amount.

What happens if you stop paying a loan after partial repayment

If a loan was paid regularly for some time and then payments stopped, the first thing the creditor will do is contact the bank's collection department. Its employees will inform the debtor about the possible consequences of avoiding payment. They may contact the borrower via SMS, phone calls, or personal meetings.

The next step is going to court. As a rule, the creditor files a lawsuit if loan payments are not received for several months. Then the bank has the opportunity to collect money from an unreliable client through bailiffs. Much less often, organizations resell borrowers' debts to collection agencies.

What are the risks of complete non-payment of a loan

If loan payments are never received, the debtor may well face criminal liability if their actions are deemed fraudulent. However, simple avoidance of payment cannot be grounds for initiating a criminal case. According to the legislation of the Russian Federation, a case can be opened against a borrower if:

  • they are an individual;
  • the bank has already sued them for failure to fulfill obligations;
  • the debt amount to the bank exceeds 2,250,000 RUB;
  • the borrower is evading the fulfillment of obligations.

At the same time, not every failure to fulfill obligations will be considered malicious evasion. Thus, it is impossible to prosecute a person who truly does not have the means to pay the loan under this article.

According to judicial practice, malicious evasion includes:

  • concealment of income, property, or bank accounts;
  • providing false information about financial status to bailiffs;
  • changing personal data in order to hide from bailiffs;
  • changing place of residence or place of work;
  • refusal to provide necessary documents or information.

Article 177 of the Criminal Code of the Russian Federation provides for punishment in the form of a fine of up to 200,000 RUB, compulsory labor for up to 480 hours, forced labor for up to 2 years, arrest for up to six months, or imprisonment for up to 2 years.

The decision to take a case to court lies solely with the credit institution. The bank does not need your consent to file a lawsuit. The document confirming the debt will be the loan agreement issued in your name.

In the case of small debts (up to 500,000 RUB), summary proceedings apply. That is, after the lawsuit is filed, the judge makes a decision on the case alone. In this case, the defendant will not be able to express their point of view. However, from the moment you receive the order, you will have 10 days to challenge the court's decision. If the debt amount exceeds 500,000 RUB, or if you do not agree with the plaintiff's claims and the order was canceled at your initiative, the court will schedule a hearing, of which you will be notified by summons.

Despite the fact that you will only learn about the fact that you have been sued upon receiving a notification at your registered address, this is no reason to panic, turn off your phones, or ignore the upcoming hearing. According to legal practice, with competent actions by the defendant, the judge can significantly reduce the amount of debt, awarding only the repayment of the loan principal and legal costs.

  1. Upon receiving a summons, verify that your bank has actually filed a lawsuit against you.
  2. Contact the secretary of your judicial district to clarify the collection amount and the bank's claims.
  3. Prepare all documents that can confirm your difficult financial situation.
  4. Do not ignore court hearings.

What measures do bailiffs use to recover funds

If the court has satisfied the bank's claim, but the borrower continues to refuse to pay the debt, the writ of execution is sent to the Federal Bailiff Service. The bailiff initiates enforcement proceedings based on the creditor's application and the court's decision. After this, the bailiffs apply the following measures to return funds to the bank:

  • withholding up to 50% of wages (Clause 2, Article 99 of Law No. 229-FZ);
  • debiting money from the debtor's bank accounts (from 25% to 50%);
  • seizure of the debtor's property that can be sold for funds (Article 84 of Law No. 229-FZ);
  • seizure of cash (Clause 1, Article 70 of Law No. 229-FZ).

If the debtor's evasion of paying creditor debt has been proven, in accordance with Article 177 of the Criminal Code of the Russian Federation, the following actions may be applied to them:

Can a bank sell a debt to debt collectors

В соответствии с п.1 статьи 382 Гражданского кодекса РФ право, закрепленное за кредитором, может быть передано без согласия заемщика третьему лицу (коллекторскому агентству). Такой мере воздействия банком предшествуют письма, телефонные звонки должнику, личные встречи в офисах банка, обращение в суд, разбирательства. Банки прибегают к этой мере воздействия в том случае, если вышеперечисленные меры по возврату долга не привели к положительному результату. При этом банк обязан письменно уведомить должника о переуступке права требования. Зачастую пункт о перепродаже долга коллекторам прописывается в действующем кредитном договоре.

Между банком и коллекторским агентством может быть заключен один из двух видов договора: агентский или договор цессии. При просроченном кредите сроком до полугода, банк заключает с коллекторами агентский договор. В этом случае банк все еще является вашим кредитором, но услугу по возврату задолженности оказывает, непосредственно, коллекторское агентство. Если кредит просрочен на год и более банк по договору цессии продает право требований коллекторам и, как правило, после переуступки банк не имеет к вам никаких претензий. При этом размер общего долга, процентов на просроченную задолженность и штрафы перед коллекторами остаются прежними.

Что делать, если долг передан коллекторскому агентству

Когда заемщик получил заказное письмо или уведомление о том, что новым кредитором стало коллекторское агентство, ему необходимо поступить следующим образом:

  1. Первым делом необходимо запросить доказательства, то есть договор цессии. Если взыскатели не предоставляют договор, то, возможно, между банком и коллекторским агентством заключен иной договор или должнику звонят мошенники. Не стоит забывать, что коллекторское агентство можно проверить через реестр Федеральной службы судебных приставов. Если в реестре ФССП отсутствуют данные о коллекторском агентстве, значит коллекторы работают нелегально.
  2. Если доказательства получены, лучше не игнорировать звонки коллекторов и соглашаться на переговоры. Таким образом, должник получает шанс договориться с коллекторами на рассрочки, частичные выплаты или изменения сроков выплат.
  3. Если коллекторское агентство отказывается идти на компромиссы, должник вправе дождаться обращения взыскателями в Мировой суд. Но есть вероятность, что в дальнейшем будут подключены судебные приставы.

  1. Кредитные каникулы. Другими словами, кредитор может предоставить отсрочку платежа на срок до полугода. Имейте в виду, кредитные каникулы неизбежно приведут к увеличению срока кредита либо к увеличению ежемесячного платежа. Банк идет навстречу благонадежным клиентам с положительной кредитной историей, но с большой вероятностью откажет тем, у кого в прошлом были задержки по оплате.
  2. Реструктуризация кредита. То есть пересмотр условий кредитования. Это не поможет избежать очередного платежа по кредиту, но по крайней мере сможет уменьшить его ежемесячную сумму. Чаще всего банк просто увеличивает срок выплаты долга на 2-3 года. Гораздо реже он может предоставить льготный период, когда заемщик может выплачивать только тело кредита или, напротив, только проценты.

Запрашивая реструктуризацию или кредитные каникулы, внимательно обдумайте, когда и откуда вы сможете получить деньги на оплату долга. В противном случае ваши слова для кредитора будут пустым звуком, и навстречу вам не пойдут.

К тому же не забывайте о том, что при обращении в банк вам понадобится документально подтвердить свое тяжелое финансовое положение. То есть «не рассчитал траты» не является для кредитора уважительной причиной и вероятнее всего вам откажут.

А подтвердить невозможность оплаты кредита могут такие документы как:

  • приказ о сокращении или копия трудовой книжки;
  • копия судебного иска, если причиной неоплаты является задержка заработной платы со стороны работодателя;
  • справка об инвалидности;
  • выписка из медицинской карты об имеющейся тяжелом заболевании, которое временно не позволяет вам работать;
  • свидетельство о рождении ребенка.

В завершение расскажем вам, что ни в коем случае нельзя делать, если по какой-то причине не можете оплатить имеющийся кредит:

  1. Брать новый заем для выплаты предыдущего. С большой вероятностью вы не сможете погасить и новую задолженность, тем самым загнав себя в долговую яму.
  2. Игнорировать звонки банка. В противном случае кредитор вправе обратиться в суд и в полной мере взыскать с вас долг через судебных приставов.
  3. Объявлять себя банкротом. Банкротство — это крайняя мера. И нужно отдавать себе отчет в том, что кроме списания долга мера принесет с собой и множество сложностей. Например, таких как запрет на выезд из страны или невозможность кредитоваться в будущем.
