  • Death of the debtor — for any reason.
  • Assignment of disability group I or II to the client, resulting in the loss of working capacity.
  • Being on sick leave for an extended period.

The list may be more extensive. The above are the most common grounds on which the obligation to repay the debt to the bank passes to the insurance company.

The insurance premium (payment for the policy) is paid by the borrower. The cost of the policy is calculated based on the amount and term of the loan agreement. The insurance is issued for the entire duration of the agreement. These additional expenses are the reason why borrowers try to refuse insurance.

Following numerous appeals by bank clients to regulatory authorities, this scheme is no longer used. However, the problem remains relevant, as insurance is applied for most credit products despite the opinions of borrowers. Banks act as follows:

  • If the client refuses to issue a policy, the lender refuses to conclude the loan agreement.
  • If the insurance is not issued, the bank increases the interest rate or worsens the remaining loan terms.

Consequently, a potential client is placed in a position where they have no choice. In most cases, banks apply an option whereby the application receives a negative decision if the client refuses to issue a policy. The problem is exacerbated by the fact that the insurance premium can be substantial in cost.

Having lost working capacity, the debtor is not released from obligations to the bank. Without insurance, they will have to pay the loan regardless of the borrower's situation. The consequences of non-payment can be extremely undesirable for the borrower. When signing the agreement, the client can make one of the following decisions:

  • Agree to conclude an insurance contract and pay the cost of the policy.
  • Agree to an increase in the interest rate and a worsening of the remaining terms of the agreement.
  • Refuse the bank's offer — this is most likely to cause a negative decision on the application by the lender.

Consequently, the borrower has every right to refuse additional services, but such a decision will negatively affect the terms offered by the bank. In some cases, the lender will give a negative response to the application. So far, there are no solutions to this problem.

How to cancel mortgage insurance

A mortgage is a type of secured lending in which the real estate property is pledged to the lender (bank). Insuring the mortgage property is a statutory requirement that cannot be bypassed. In accordance with Article 31 of the Federal Law "On Mortgages," all expenses for insuring the mortgaged property are covered by the pledger—the borrower.

This rule is enshrined in law to reduce the financial risks of credit institutions when servicing mortgage loans. In this case, if the borrower refuses to conclude a property insurance agreement, the bank has every right to deny them the loan.

Life and health insurance services for the borrower when taking out a mortgage are not mandatory, so rules similar to unsecured consumer loans apply to them. You can decline them, but such a decision by the borrower will negatively affect the mortgage agreement process.

How to cancel insurance after taking out a loan

Under mortgage agreements, having an insurance policy is a mandatory condition. The lender may make concessions in this regard, but in practice, such decisions do not happen.

If a borrower is interested in obtaining funds via an uncollateralized loan, they agree to take out an insurance policy. The policy becomes effective simultaneously with the loan agreement.

Given that any civil law contracts are concluded on the principles of freedom of contract, either party can terminate the agreement at any time. Accordingly, the borrower has the full right to refuse insurance services. To do this, it is sufficient to submit an application to the insurance company.

The difficulty lies in the fact that the loan agreement contains a clause stating that the borrower undertakes to maintain a valid policy throughout the entire term of using the loan funds.

If this condition is violated, the bank reserves the right to demand early repayment of the entire debt amount. You won't be able to hide the lack of a policy, as the insurer will immediately transmit this information to the bank.

How to prove that insurance was imposed by the bank

Disagreements between the lender and the borrower frequently end up in court. At the same time, the burden of proving that services were imposed falls on the borrower. The problem is that proving this is nearly impossible, as the bank never puts the condition of mandatory policy purchase in writing anywhere.

A direct statement that a loan is issued only if insurance is purchased is considered a serious violation. Therefore, in loan program descriptions, insurance appears as an additional service that citizens opt into voluntarily. On September 1, 2020, amendments were made to civil legislation regarding the refund of a portion of the insurance premium upon early repayment of a loan debt.

How to return part of the insurance premium upon early loan repayment

In accordance with Part 10 of Article 11 of the Federal Law "On Consumer Credit (Loans)," the borrower has the right to return a portion of the insurance premium paid to the insurer when taking out a consumer loan agreement.

This same rule applies to mortgage agreements: if the debt is repaid ahead of schedule, the client submits an application to the bank or insurance company. The decision on the application and the calculation of the refund amount are carried out within 7 working days from the date of receipt of the application (by the creditor or insurer). This rule applies only if no events indicating the occurrence of an insured event have occurred.
