Who is a cardholder?

Who is a bank cardholder?

Most often, a cardholder (whether debit, credit, or overdraft) is the person who opened the account to which the plastic card is linked. That is, this is the person who concluded an agreement with the bank for the opening and maintenance of a bank account, and then received the card. In this case, the cardholder is also its owner.

Cardholder or card owner

Situations where the cardholder and the owner are two different people are also permitted. For example, when a bank issues an additional card linked to the primary one. In this case, the account belongs to the owner, but the plastic card can be used by the person to whom it was directly given. Although all individuals holding additional cards can perform account transactions, the person in whose name the cards are issued remains responsible for them.

Cardholder liability

Holding a plastic card gives the bank client the right to manage the funds in the account as they see fit. In other words, the bank cannot prohibit them from making transfers or paying for goods and services (except in cases where there is suspicion of unauthorized fund withdrawals). Furthermore, the card owner has the right to set spending limits, receive reliable information regarding financial transactions, and obtain everything necessary to use the card.

The responsibilities of a bank card owner are worth discussing separately and in a bit more detail:

  1. The owner is required to comply with the law. Therefore, the bank has the right to block the cardholder's account if it suspects them of conducting suspicious transactions. These include any transactions that may violate the law or be disadvantageous to the client.
  2. The cardholder does not have the right to use the account for entrepreneurial activities — special business settlement accounts exist for that purpose.
  3. Only the owner bears responsibility for the funds located in the account. This means the bank is not liable if fraudsters gain possession of the card.

Who is a credit cardholder?

A credit card holder is essentially the same as a regular bank card holder. However, they are simultaneously a bank borrower, so the list of their obligations will be broader than in the previous case. In addition to all the above, the cardholder undertakes to:

  • pay interest accrued on the debt amount;
  • make timely payments for using the credit card;
  • make a monthly payment no less than the minimum amount.

Note.

If fraudsters take possession of a credit card, the owner will still bear responsibility before the bank. Obligations can be lifted only if a court proves unauthorized use of the card by third parties.

What transactions can the cardholder perform?

Certain card transactions are available exclusively to their owners. For example, when a service needs to be performed at a bank branch. Thus, in addition to the card itself, the cardholder will need to present an identity document. Only after that will they be able to gain access to online banking, generate a transaction statement, connect or disconnect a service, make a transfer, and so on.

Identity verification will also be required to obtain information or perform transactions via the bank's hotline. A financial institution employee has the right to request the client's passport details, information on recent account transactions, a code word, and so on.

What transactions can a non-cardholder perform?

Essentially, even a person who is not the owner of the bank card, but knows its password, can perform practically all operations related to paying for goods and services. For example:

  • make purchases in stores for any amount;
  • cash out money through ATMs or perform any other operations using self-service devices.

In addition, if a person has access to mobile banking, they can also transfer money to clients of the same or another financial institution, conduct online payments, and use any other online banking tools.

Note.

Entering a PIN code is not required for certain purchases. For example, when the purchase amount does not exceed 1,000 RUB if the cardholder pays with Mastercard, or 3,000 RUB with Visa.

How to protect yourself from unauthorized debiting of funds

As plastic cards become more widespread, cases of unauthorized fund withdrawals from accounts are also becoming more frequent. Fraud is most often the cause. However, this is not the only reason why money may be written off without the owner's consent:

  1. Loss of the card or disclosure of confidential information can lead to fraudsters taking over the funds in the account.
  2. Erroneous fund write-offs due to a bank operating system glitch.
  3. Withdrawal of money from the account pursuant to a writ of execution.
  4. Automatic monthly deductions when setting up subscriptions.

These are the most common, but not the only reasons you could lose your money. Therefore, to avoid unauthorized fund withdrawals from your account, you need to follow a few simple rules:

  • do not share card details with third parties;
  • do not make online purchases on unverified, suspicious websites;
  • do not carry a PIN code written down on paper;
  • enable mobile banking to stay informed about card transactions and be able to block the card in time;
  • make sure the ATM is not equipped with any suspicious devices before using it;
  • instantly block a lost bank card;
  • do not interact with people trying to find out your card details;
  • do not confirm transactions you did not make.

Can I restrict card transactions if I give my card to other people?

Yes, you can set a spending limit, ban certain transactions, and more. To do this, you will need to contact your servicing bank with your passport and the card itself.

Is a power of attorney required for a bank card if you give it to third parties?

According to the law, only you can use a bank card issued in your name. For another person to pay with it, a notarized power of attorney is required. However, in practice, only a few act according to the law. There is only one result in such a case — if the actual cardholder commits unlawful acts and you cannot prove your non-involvement, you will be the one responsible for someone else's misconduct.

Who is the holder of an unpersonalized bank card?

An unpersonalized bank card is little different from a regular one. The only difference is that the owner's initials are not embossed on the front side. However, the holder is still the person to whose account the plastic card is linked.

Can a bank card holder restrict the write-off of funds in favor of bailiffs?

The powers of bailiffs are set out in the Civil Code. Seizing an account and writing off money from it to pay off a debt are among them. Therefore, unfortunately, the cardholder does not have the right to prohibit the bank from writing off money under an enforcement writ. The only way to lift the seizure from the account is to negotiate an alternative debt repayment method with the bailiffs.

When paying for a purchase, the bank debited funds from the account twice, what should I do?

In this case, you need to write an application to the bank, attaching proof of the unauthorized withdrawal of money. The bank is obligated to respond to your request and return the money. There is a simpler and faster way to resolve such a situation: take out insurance that covers unauthorized money withdrawals.

I have a virtual card, what can I do with it?

A virtual card is practically the same as a regular bank card. The only difference is that it is not issued to you in physical form. You can use it online: make purchases in online stores, carry out transfers, pay bills, etc.
